Fansky policies

Terms of Service

These terms explain your rights and responsibilities when you browse, buy, sell, and use services on Fansky. By signing up for or using Fansky, you agree to these terms, our Privacy Policy, Refund Policy, and Community Guidelines.

Effective date: March 12, 2024

01Scope and your account

Fansky is operated by the Fansky team ("we" or "us"). These terms cover the Fansky website and related services, including shops, posts, memberships, tips, messages, and notifications.

  • You must be at least 18 years old to sign up for and use Fansky. Some content or features may have a higher age requirement.

  • Give us true and accurate sign-up information and keep it up to date.

  • Keep your account and sign-in methods secure. Activity under your account is treated as yours; contact us right away if you notice anything unusual.

  • Use only your own account. Do not lend, transfer, buy, or sell accounts.

02Our role

Fansky is a platform where creators sell digital works and connect with fans. Products in a shop are published and sold by that shop’s creator, who is the seller and is responsible for the product and its description.

We provide shop tools, payments, delivery, after-sales support, and payouts, and we step in on disputes as described in the Refund Policy. We do not guarantee the quality, style, or release schedule of any creator’s work.

03Prices, orders, and payment

  • Creators set their own prices. The checkout page shows the currency you will be charged in. Some payment methods may involve currency conversion or provider fees.

  • Payments are processed by third-party payment providers. Available payment methods vary by region and order.

  • FS Points are Fansky’s in-site points. You can use them to pay for orders and receive refunds. Points cannot be exchanged for cash or transferred to others.

  • Coupons, member prices, and other discounts follow the rules shown with them and cannot be used once expired or when conditions are not met.

  • An order takes effect once payment succeeds. If there is an obvious pricing error or an abnormal order, we may cancel it and give a full refund.

04Delivery and license for digital products

After payment, you can download or view your purchase from the order page. Buying a digital product gives you a personal license to use it, not ownership of the work or its copyright.

  • Unless the creator says otherwise, purchases are for your own non-commercial use only.

  • Do not resell, share, publicly distribute, or upload purchased content elsewhere, and do not sell or share download links or archive passwords.

  • To protect creators, some files carry buyer-specific watermarks or tracing marks used to identify the source of leaks. Do not try to remove or alter them.

  • The exact scope of the license (for example, whether fan works are allowed) follows the product page.

05Memberships and tips

  • Each membership payment gives you 30 days of benefits and does not renew automatically. We will remind you by email and SMS 5 days before it ends so you can renew.

  • Creators decide the benefits, which may include members-only posts, product discounts, or free access.

  • If a creator changes a membership price, it only affects future renewals, not periods you have already paid for.

  • Tips are voluntary support for a creator and do not correspond to any product or service.

06Refunds and after-sales support

If a download fails, a file is broken, or a product does not match its description, you can request after-sales support from the order page within 5 days after payment. See the Refund Policy for the process, eligibility, and timelines.

Please request after-sales support first. If you file a chargeback with your bank or payment provider without doing so, we may restrict your account.

Read the Refund Policy

07Creator responsibilities

  • You must own the copyright to the works you sell or have the right to sell them, and your content must not infringe anyone else’s rights.

  • Product titles, descriptions, previews, and files must be accurate and consistent, and must not mislead buyers.

  • Respond to buyers’ after-sales requests promptly and meet the timelines in the Refund Policy.

  • Use buyers’ display names, email addresses, and other details only to fulfill orders and provide after-sales support. Do not use them for anything else or share them with others.

08Fees, payouts, and taxes

  • Service fees: we charge a service fee on each transaction at our published rates. Payment provider fees, currency conversion, and withdrawal fees may also apply, as shown in your creator dashboard.

  • Payouts: once a transaction is complete, earnings go to your pending balance and can be withdrawn on the schedule and through the methods shown in your dashboard, including PayPal, Wise, and bank transfer.

  • Holds: if your account is suspected of a violation or fraud, or an order is in an after-sales case, dispute, or compliance review, we may temporarily hold the related funds until the matter is resolved, and we will tell you why as soon as we can.

  • Refunds and chargebacks: when an order is refunded or charged back, the amount is deducted from your balance. If your balance is not enough, we may deduct it from your future earnings.

  • Taxes: you are responsible for reporting and paying taxes where you live. We may ask for tax information and, where the law requires, withhold taxes.

09Prohibited content and conduct

When using Fansky, you must not:

  • post illegal content or any sexual content involving minors;

  • infringe others’ copyright, trademarks, likeness, or privacy;

  • commit fraud, money laundering, or unauthorized payments, or abuse refunds, discounts, or after-sales processes;

  • harass or threaten others, or break the Community Guidelines;

  • scrape content at scale with automated tools, or interfere with or attack our systems;

  • create multiple accounts to get around restrictions or bans.

Read the Community Guidelines

10Reports, enforcement, and appeals

  • If you see content or behavior that breaks our rules, tell us through the report option on the page or a support ticket. Include links and details where you can.

  • We review reports and our own risk signals, but we are not obliged to pre-screen all content.

  • After review, we may remove content, restrict features, or take action on an account, and we will notify the users involved.

  • If you disagree with a decision, you can appeal through a support ticket within 7 days of being notified, and we will review it again.

11Interactions between users

You are mainly responsible for your own communications, transactions, and disputes with other users. We offer after-sales support, reporting, and platform review to help resolve problems, but we are not responsible for what other users say or do.

Please do not move transactions off Fansky. Transactions made outside Fansky are not covered by our after-sales and refund protections.

12Third-party services and integrations

  • You can link Discord to receive the roles that come with your membership. Creators can sync memberships to Discord roles or connect Fansky to their own sites and apps through OAuth and webhooks. Once connected, you are responsible for how those sites and apps use the data.

  • We are not responsible for the availability or content of third-party services, or for how they handle data.

13Intellectual property and infringement reports

Copyright in each work belongs to its creator or original rights holder. The Fansky name, logo, and site design belong to us.

By posting content on Fansky, you allow us to store, display, process, and promote it as needed to provide our services. This permission ends when you delete the content, except for products that have already been sold.

If you believe content on Fansky infringes your rights, email us proof of your rights and links to the content. We will review and act on valid reports promptly. Accounts that repeatedly infringe will be closed.

14Account restrictions and termination

To protect creators and buyers, we monitor for risky activity. If you break these terms, the Community Guidelines, or the law, we may warn you, restrict features, remove content, or close your account, depending on the situation.

You can ask to delete your account at any time. Please finish any open orders, after-sales cases, and payouts first. Transaction records we must keep by law will be retained after deletion.

15Disclaimers and limitation of liability

  • We work to keep Fansky running smoothly, but service may be interrupted by maintenance, outages, or events beyond our control. The service is provided as is.

  • We make no guarantees about content published by creators or about third-party sites and services.

  • To the extent the law allows, we are not liable for indirect losses, and our liability for any single transaction is limited to the amount you paid for that order.

  • Nothing in these terms affects consumer rights you have under local law that cannot be waived by agreement.

16Indemnity

If a third party brings a claim against us because you broke these terms or the law, infringed someone’s rights, or because of content you posted, you will cover our resulting losses and reasonable costs, including legal fees.

17Governing law and disputes

These terms are governed by the laws of the place where Fansky’s operator is based. This does not affect any consumer rights you have under your local law that cannot be waived by agreement. If a dispute arises, please contact us first by support ticket or email so we can try to resolve it. If we cannot, it will be handled by a competent court or authority under the applicable law.

18Changes to these terms

We may update these terms as our services or the law change, and we will update the effective date on this page when we do. We will give advance notice of major changes by site notification or email. If you keep using Fansky after an update takes effect, you accept the new terms.

19General

  • These terms, together with the Privacy Policy, Refund Policy, and Community Guidelines, are the entire agreement between you and us about using Fansky.

  • If any part of these terms is found invalid, the rest remains in effect.

  • If we do not enforce a right right away, we have not waived it.

  • You may not transfer your rights or obligations under these terms without our consent. We may transfer ours in a merger, acquisition, or similar event.
